STANDING UP FOR CRIMINAL DEFENDANTS' RIGHTS ON THE O'REILLY FACTOR, IN A POST 9-11 WORLD

Silver Spring, MD (Jan. 25, 2006) - On January 25, 2006, with a rebroadcast on February 5 during Super Bowl Sunday halftime, partner Jon Katz speaks on the O'Reilly Factor in support of  the dismissal of the mistried counts in the criminal prosecution of Professor Sami Al-Arian, who was acquitted by a jury of the most serious charges against him for allegations related to terrorism. Jon emphasizes that the jury has already spoken after a multi-million dollar, six-month federal trial where Professor Al-Arian was detained for over three years, while presumed innocent under the Constitution every step of the way. It is now time to move on. 

Jon pointed out that Professor Al-Arian's attorneys successfully argued to the jury that the First Amendment does not permit a conviction based solely on the defendant's views, and that the jury favored Professor Al-Arian 10-2 on all but one mistried count. Bill O'Reilly concedes that Jon Katz's argument for dismissal is reasonable, despite asserting he is not convinced. Mr. O'Reilly has been on Professor Al-Arian's back ever since accusing him of being a terrorist during a late 2001 interview that led to Professor Al-Arian's suspension at the University of South Florida in violation of the First Amendment
